InGo, Inc. (“InGo”, “we”, “our” or “us”) is a U.S.-based company which provides a communication solution that empowers audience members to share experiences.  Our online tools and website at ingo.me are provided to customers including but not limited to marketers and event organizers (“Customers”) and to end users participating in experiences to enable them to connect with fellow participants, receive recognition, and invite their connections to join (the foregoing services, together with the online tools and the Website, the “Services”).

We respect your privacy. We won’t use your personal information other than as described in this privacy statement (“Privacy Statement”).

This Privacy Statement applies to personal information that we receive directly from you, or through our Social Partners (as defined below) on your behalf, in connection with our Services. The Services are provided by InGo and may be provided by InGo on behalf of a Customer. As such, when you use the Services, your personal information will be provided to both InGo and to the Customer using the Services in relation to such experiences. Accordingly, when you use the Services, you understand that you will be providing personal information to InGo, which we will use in accordance with this Privacy Statement.

  1. WHAT INFORMATION DOES INGO COLLECT?

We collect the following types of information from our users:

1.1 Information You Provide to Us or Authorize Us to Obtain

We may receive and store any information you submit directly to us via the Services, or otherwise authorize us to obtain through one of your social media or address book accounts, including but not limited to as Facebook, LinkedIn, Twitter or Xing (“Social Partners”) – though from time to time we may add or change the Social Partners with whom we work. Please note, when you use your social account in connection with the Services, you and/or the Social Partner are in control of the personal information which is released to us. More information is provided on this point in the section of this Privacy Statement entitled “SOCIAL PARTNERS” below.  We also collect information that you provide to us when you sign up to receive a demonstration and contact us by email or through the “Contact Us” form on our Website (www.ingo.me). If you inquire about a career at InGo, you have the option of sending to us a resume containing personal data about you and which we will use solely for employment evaluation purposes. We may utilize a third party provider to host our job applications and assist with the application process. Such third party providers may have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

The types of personal information collected either directly from you or through any applicable Social Partner may include your full name, email address, gender, username, demographic information, and any other information necessary for us to provide the Services. In addition to this information, we may collect certain information automatically when you use the Services which may also be considered personal information. Finally, we may also collect information about your contacts in connection with your use of a Social Partner, both of which are discussed in further detail below.

While we may accept payment from our Customers for service fees via payment card, we do not store payment card information; rather we utilize a payment processor and store only an electronic receipt that sets forth confirming payment details, but not complete payment card information. 

1.2 Information Collected Automatically

When you use the Services, we will automatically receive and store certain types of information utilizing background local storage and session storage technologies (“Cookies”), such as information regarding your computer’s IP address or your mobile device’s MAC address, browser information (such as what type of browser you use and what version of the software it uses which could impact your experience of using the Services), and Facebook Page fan status (or other similar types of information from other Social Partner sites as may be applicable).  When we use Cookies, we may use “session” Cookies that last until you close your browser or “persistent” cookies that last until you or your browser delete them. You may change your browser settings to decline the use of Cookies.

We use Google Analytics, a web analytics service of Google Inc., which uses Cookies to identify the frequency of use of certain areas of our website and to identify preferences. For more information regarding how Google collects, uses, and shares your information please visit http://www.google.com/policies/privacy/partners/. 1.3 Information About Your Social Contacts

We may receive and store information about your connections, followers and contacts from the social account you use to register for the event (where this is authorized by you and/or the Social Partner as determined by that Social Partner and its own privacy policy and privacy settings).  The only information that we may obtain regarding your contacts is the information allowed by our Social Partners.

1.4 Information Received from Customers

In some instances we may receive personal information directly from Customers pursuant to our services agreement with them. In this regard, a Customer’s use of your personal information is subject to the Customer’s own separate privacy policy – and not this Privacy Statement. Some of the Services we may provide to a Customers may include the placement of content on our Customer’s site that contains a widget that you may choose to use to allow the exchange of your information with InGo and third party social media sites. These features may collect your IP address, which page you are visiting, and may set a cookie to enable the feature to function properly. Your interactions with these features on an InGo Customer site are governed by the privacy policy of the Customer. If you are a data subject and wish to exercise any of your rights under applicable law, to the extent InGo is a processor of your personal information, we may need to forward your request we receive to such Customer in compliance with applicable law.

1.5 Storage and Retention of Information

We retain the personal data we collect for so long as reasonably necessary to fulfill the purposes for which the data was collected and to perform our contractual and legal obligations.  

We take reasonable administrative, physical and technical precautions to protect your personal data and communications between us.  This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your data that they will protect the data with reasonable safeguards. 

No Internet or e-mail transmission is ever fully secure or error free, however.  We therefore cannot guarantee absolute security of your data, and we are not responsible for processes and networks that we do not control.  Users assume the risk of security breaches and the consequences resulting from them.  Please be careful in deciding what information you send to us via email or over the Internet. 

  1. HOW DOES INGO USE THE INFORMATION IT RECEIVES?

InGo uses the information it receives as described in this Privacy Statement, including for the following purposes:

(i)  to assist you to sign up for an experience where the Customer is using the Services offered through the Services. Essentially, the Services will (where you have authorized us to do so) use the information contained within your social profile to pre-populate an experience registration form to facilitate your participation;

(ii)  to prepare invitations and/or updates to be sent to your contacts/friends/connections in relation to your participation related to an experience, and only where you consent and agree to send the relevant invitations and/or updates;

(iii)  to inform you of changes in Services or new InGo services that you might find interesting;

(iv)  to fill employment positions;

(v)  to determine, analyze, develop and improve our products and services;

(vi)  to contact you regarding the Services and/or to communicate with you in response to any questions or queries which you may have about your use of the Services, as well as for other internal record keeping and management purpose;

(vii)  for compliance with any regulatory or legal obligations;

(viii)  as set forth below in the section of this Privacy Statement entitled “Will InGo Share Any of the Personal Information it Receives?”; and

(ix) for other legitimate business purposes.

  1. Will InGo Share Any of the Personal Information it Receives?

Personal information about our users is an integral part of our business. We will not rent or sell your personal information to anyone, except as otherwise described in this Privacy Statement or as required by law. However, in order to provide the Services, as well as for the operation of our general business administration, we may share or disclose your personal information as described below.

Customers: We will share your personal information with the applicable Customer. As stated above, where a Customer opts to use the Services in order to facilitate your experience, your personal information is provided to both InGo and the Customer. In this regard, a Customer’s use of your personal information is subject to the Customer’s own separate privacy policy – and not this Privacy Statement. InGo does not and cannot control how the applicable Customer uses your personal information. You should review the applicable Customer’s separate privacy policy before using the Services. 

Service Providers and Agents: We employ other companies and people (e.g., technical consultants, data center providers, job hosting providers, payment processors, technology providers and marketing analysts) to perform tasks on our behalf (“Providers and Agents”) and we may share your information with them in order to provide the Services to you, as well as to assist us in our everyday tasks. Unless we tell you differently, InGo’s Providers and Agents do not have any right to use the personal information we share with them for any reason other than assisting us in providing the Services (where applicable) or otherwise assisting InGo in its daily business functions. All such Providers and Agents are instructed and appointed with appropriately worded contracts.

Business Transfers: In the event we are acquired by, or merge or consolidate into, another entity, or if there is a sale of our assets (in whole or in part), your personal information may be transferred to the entity acquiring us or our assets, or that survives the merger or consolidation.  Moreover, in the unlikely event that InGo goes out of business or enters bankruptcy, personal information would be one of the assets that is transferred or acquired by a third party as part of such disclosure or bankruptcy.

Protection of InGo and Others: We may share or otherwise disclose personal information when we believe in good faith that release is necessary to comply with the law; enforce or apply our Terms of Service and/or other agreements; or protect the rights, property, or safety of InGo, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction where it is appropriate and lawful to do so.

Anonymous, Aggregated Data: Our Services gather anonymous aggregated data like web statistics and demographics statistics on our users (among other things). This anonymous, aggregated data is not personal information and it cannot be used to re-identify any particular individual. We use the anonymous, aggregated data to help us run our business, attract advertisers/investors, and measure the effectiveness of our Services. We may choose to share, sell or publicize certain anonymous aggregated data about our Services and users. This data is anonymous and in summary form (i.e., it is not personal information and will not include information such as your name, email address, home address, etc.).

With Your Consent: Except for transfers permitted by this Privacy Statement (or required by law), you will be notified when your personal information may be shared with third parties and will be given the opportunity to object to the sharing of this information.

  1. SOCIAL PARTNERS

When you engage an experience through the Services using one of your social accounts, you authorize InGo to receive certain information from the applicable Social Partner. The applicable Social Partner controls what personal information we receive about you, or in relation to some Social Partners, this control may rest with you and your own privacy settings on a particular social site. As such, if you have any concerns over the personal information which a Social Partner provides to us, we recommend you review the privacy settings within the relevant Social Partner site and or review the privacy policy applicable to the social account you use to register for an experience via the Services.  InGo is not responsible or liable for acts or omissions of a Social Partner or a Social Partner’s failure to comply with their privacy policies or applicable law.

  1. WILL MY PERSONAL INFORMATION BE TRANSFERRED TO OTHER COUNTRIES?

As stated above, InGo is a U.S.-based company. As such all personal information which is collected and used by InGo as set out in this Privacy Statement will be transferred to or accessed in the United States, and by your proceeding to use the Services, you understand that your personal information will be transferred to and stored in the United States. Please note that InGo may from time to time also use third party contractors outside of the U.S. and the E.U. to perform services on its behalf (for further information, see the section of this Privacy Statement entitled “Service Providers and Agents”). InGo will ensure that such third party contractors have entered into appropriate contracts relating to protection of personal information that they may access.

  1. GROUNDS FOR USING YOUR PERSONAL INFORMATION

We rely on the following legal grounds to process your personal information:

Consent. Some uses of your personal data as described in this Privacy Statement are subject to your consent, such as marketing email communications.  To withdraw your consent, please contact us at support@ingo.me.  You may also refrain from providing, or withdraw, your consent for Cookies via your browser and mobile settings.

Performance of a contract. We may need to collect and use your personal information to permit your and our Customers’ use of the Services. 

Legitimate Interests. We may use your personal information for our legitimate interests to provide the Services and to improve our Services.  We may use technical information as described in this Privacy Statement and use personal information for our marketing purposes consistent with our legitimate interests and any choices that we offer or consents that may be required under applicable law. 

Compliance with Legal Obligations. We may use your personal information as necessary to comply with our legal obligations.

  1. CONDITIONS OF USE

If you decide to use or otherwise access the Services, your use/access and any possible dispute over privacy is subject to this Privacy Statement and our Terms of Service, including limitations on damages, arbitration of disputes, and application of Delaware state law.

  1. THIRD PARTY APPLICATIONS/WEBSITES

The Services may permit you to link to other applications or websites. Such third party applications/websites are not under InGo’s control, and such links do not constitute an endorsement by InGo of those other applications/websites or the services offered through them. The privacy and security practices of such third party application/websites are not covered by this Privacy Statement, and InGo is not responsible for the privacy or security practices or the content of such applications/websites.

  1. YOUR PRIVACY RIGHTS, CHOICES AND DISCLOSURES

9.1   General.

This section is subject to specific disclosures on privacy rights set forth below. We are committed to facilitate the exercise of your rights granted by the laws of your jurisdiction, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale of your personal information (as applicable). We will do our best to honor your requests subject to any legal and contractual obligations.  If you would like to make a request, cancel your account or request we delete or no longer use your account information to provide you Services, you may submit the form located at https://ingome.typeform.com/to/UdfAGS, contact us at support@ingo.me, or if you are an InGo Customer, you may make changes to your account information.

You may opt out of receiving electronic marketing communications from us by clicking on the “unsubscribe” link on the communication or contacting us at support@ingo.me. Some non-marketing communications may not be subject to a general opt-out, such as communications about transactions, disclosures to comply with legal requirements, software updates and other support-related information. 

Subject to local law, you may have additional rights under the laws of your jurisdiction regarding your personal information, such as the right to complain to your local data protection authority.

You may be able to disable Cookies through your browser settings, but if you delete or disable Cookies, you may experience interruptions or limited functionality in certain areas of the Services. 

9.2 Your European Privacy Rights and Choices.

If you reside in the territory of Europe, your privacy rights under the European data protection law include:

  • Transparency and the right to information. Through this policy we explain how we use and share your information. However, if you have questions or need additional information you can contact us any time.
  • Right of access, restriction of processing, erasure. You may contact us to request information about the personal data we have collected from you and to request the correction, modification or deletion of such personal information, which requests we will do our best to honor subject to any legal and contractual obligations. To make a request or to ask us a question about our data practices, please contact us via email at support@ingo.me. 
  • Right to withdraw your consent at any time. When we process your personal data based on your consent, you have the right to withdraw it at any time.
  • Right to object at any time. You have the right to object at any time to receiving marketing or promotional materials from us by either following the opt-out instructions in commercial e-mails or by contacting us, as well as the right to object to any processing of your personal data based on your specific situation. In the latter case, we will assess your request and provide a reply in a timely manner, according to our legal and contractual obligations. Some non-marketing communications are not subject to a general opt-out, such as communications about transactions and disclosures to comply with legal requirements. 
  • Right to data portability. You have the right to data portability of your own personal data by contacting us.
  • Right not to be subject to an automated decision, including profiling. We do not make automated decisions using your personal data that may negatively impact you.
  • Right to lodge a complaint with a supervisory authority. If you consider that the processing of your personal data infringes your privacy rights according to the European Privacy regulation, you have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work, or place of the alleged infringement.

9.3 California Disclosures.

California Do Not Track Disclosure. At this time InGo does not respond to browser ‘Do Not Track’ signals.

California Shine The Light Law. California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. If you would like to make a request for information under the Shine The Light law, please send an email to support@ingo.me or mail your request to 4201 Wilson Blvd Floor 3, Arlington, VA 22207.  

California Consumer Privacy Act Disclosures. Under the California Consumer Privacy Act (CCPA), California residents have the right to request:

  • The categories of personal information we have collected about you;
  • The categories of sources from which the personal information is collected;
  • The business or commercial purpose of collecting or selling personal information;
  • The categories of third parties with whom we share or sell personal information;
  • The categories of personal information about you that we have sold; and
  • The specific pieces of personal information we have collected about you.

Additionally, consumers have the right to request deletion of their personal information, the right to opt out of the sale of their information (if applicable) and the right not to be discriminated against for exercising any of their CCPA rights.

We do not sell personal information for monetary consideration under CCPA. Personal data may be provided to our service providers and to third parties under Section 1798.140(t)(2)(A) of the CCPA. The Services are not intended for persons under the age of 18. InGo does not knowingly or specifically collect information about children under the age of 18 and believes that children of any age should get their parents’ consent before giving out any personal information. We encourage you to participate in your child’s web experience.

InGo may amend this Privacy Statement from time to time. Use of personal information we collect is subject to the Privacy Statement in effect at the time such personal information is collected. We respect your privacy. We won’t use your personal information other than as described in this privacy statement (“Privacy Statement”).

This Privacy Statement applies to personal information that we receive directly from you, or through our Social Media Partners (as defined below) on your behalf, in connection with our Application. The Application is provided by InGo and may be provided by InGo on behalf of an Event Organizer. HOW DOES INGO USE THE INFORMATION IT RECEIVES?

InGo uses the information it receives as described in this Privacy Statement, including for the following purposes:

(i)  to assist you to sign up for an event where the Event Organizer is using the Services offered through the Application. Essentially, the InGo Application will (where you have authorized us to do so) use the information contained within your social media profile to pre-populate an event registration form to facilitate your registration for an event;

(iv)  to notify you about potential events and people you may want to connect with at such event;

(v)  to determine, analyze, develop and improve our products and services;

(vi)  to contact you regarding the Application, Services and/or to communicate with you in response to any questions or queries which you may have about your use of the Application and/or Services, as well as for other internal record keeping and management purpose;

(vii)  for compliance with any regulatory or legal obligations; and

(viii)  as set forth below in the section of this Privacy Statement entitled “Will InGo Share Any of the Personal Information it Receives?”.

Anonymous, Aggregated Data: Our Application gathers anonymous aggregated data like web statistics and demographics statistics on our users (among other things). This anonymous, aggregated data is not personal information and it cannot be used to re-identify any particular individual. We use the anonymous, aggregated data to help us run our business, attract advertisers/investors, and measure the effectiveness of our Application. We may choose to share, sell or publicize certain anonymous aggregated data about our Application and users. However, because this data is anonymous and in summary form (i.e., it is not personal information and will not include information such as your name, email address, home address, etc.), no advertisers or third parties could ever contact you using this aggregated, anonymized data.

With Your Consent: Except for transfers permitted by this Privacy Statement (or required by law), you will be notified when your personal information may be shared with third parties, and will be given the opportunity to object to the sharing of this information.

SOCIAL MEDIA PARTNERS

When you register for an event through the Application using one of your social media accounts, you authorize InGo to receive certain information from the applicable Social Media Partner. The applicable Social Media Partner controls what personal information we receive about you, or in relation to some Social Media Partners, this control may rest with you and your own privacy settings on a particular social media site. As such, if you have any concerns over the personal information which a Social Media Partner provides to us, we recommend you review the privacy settings within the relevant Social Media Partner site and or review the privacy policy applicable to the social media account you use to register for an event via the Application.  InGo is not responsible or liable for acts or omissions of a Social Media Partner or a Social Media Partner’s failure to comply with their privacy policies or applicable law.

WILL MY PERSONAL INFORMATION BE TRANSFERRED TO OTHER COUNTRIES?

As stated above, InGo is a U.S.-based company. As such all personal information which is collected and used by InGo as set out in this Privacy Statement will be transferred to or accessed in the United States, and by your proceeding to use the Application and/or Services, you understand that your personal information will be transferred to and stored in the United States. Please note that InGo may from time to time also use third party contractors outside of the U.S. and the E.U. (e.g., Russia or Ukraine) to perform services on its behalf (for further information, see the section of this Privacy Statement entitled “Service Providers and Agents”). InGo will ensure that such third party contractors have entered into appropriate contracts relating to protection of personal information that they may access.

EU-U.S. PRIVACY SHIELD

InGo complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom, and/or Switzerland to the United States.  InGo has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  If there is any conflict between the terms in this Privacy Statement and the Privacy Shield Principles, the Privacy Shield Principles shall govern.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov.

Enforcement Powers:  InGo is subject to the investigatory and enforcement powers of the Federal Trade Commission.  We may be required to disclose personal information that we handle under the Privacy Shield in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.  

Responding to Complaints:  In compliance with the Privacy Shield Principles, InGo commits to resolve complaints about our collection or use of your personal information.  Individuals in the European Union with inquiries or complaints regarding our Privacy Shield policy should first contact InGo at privacy@ingo.me.

If neither InGo nor JAMS resolves your complaint, you may pursue binding arbitration as described in Annex I to the Privacy Shield Principles.    

Onward Transfer:  InGo does not disclose personal information to any third parties except to fulfill the purposes for which the information was disclosed or for the purposes described in this Privacy Statement – for further information, see the section of this Privacy Statement entitled “Will InGo Share Any of the Personal Information it Receives?” InGo has responsibility for the processing of personal information it receives and subsequently transfers to a third party acting as an agent on its behalf.  InGo remains liable under the Privacy Shield Principles if any of its agents process such personal information in a manner inconsistent with the Privacy Shield Principles, unless InGo can prove that it is not responsible for the event giving rise to the damage.

Choice: As stated above, except for transfers permitted by this Privacy Statement (or required by law), you will be notified when your personal information may be shared with third parties, and will be given the opportunity to object to the sharing of this information. In addition, you may always choose not to provide your personal information to InGo, although as a result you may be prevented from using the Services.

CONDITIONS OF USE

If you decide to use or otherwise access the Application, your use/access and any possible dispute over privacy is subject to this Privacy Statement and our Terms of Service, including limitations on damages, arbitration of disputes, and application of Delaware state law.

THIRD PARTY APPLICATIONS/WEBSITES

The Application may permit you to link to other applications or websites. Such third party applications/websites are not under InGo’s control, and such links do not constitute an endorsement by InGo of those other applications/websites or the services offered through them. The privacy and security practices of such third party application/websites are not covered by this Privacy Statement, and InGo is not responsible for the privacy or security practices or the content of such applications/websites.

COOKIES

Cookies are small text files stored by your browser on your computer when you visit a website.  While we currently do not use cookies, we may do so in the future.  If we do implement the use of cookies in connection with visits to our website, we would use them to recognize users and avoid repetitive requests for the same information, understand user preferences for future visits, and compile data about website interaction to help us provide a better experience in the future.

WHAT PERSONAL INFORMATION CAN I ACCESS?

InGo allows you to access your personal information for the purpose of viewing and, in certain situations, updating that information. Below is a list of the personal information you can access.  This list may change in the event the Application changes.

•    Application specific data.

USE OF THE APPLICATION BY MINORS

Our Application and the Services are not intended for persons under the age of 16. InGo does not knowingly or specifically collect information about children under the age of 16 and believes that children of any age should get their parents’ consent before giving out any personal information. We encourage you to participate in your child’s web experience.

CALIFORNIA DO NOT TRACK DISCLOSURE

At this time InGo does not respond to browser ‘Do Not Track’ signals. 

CALIFORNIA SHINE THE LIGHT LAW

California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. CHANGES TO THIS PRIVACY STATEMENT

InGo may amend this Privacy Statement from time to time. Use of personal information we collect is subject to the Privacy Statement in effect at the time such personal information is collected. If we make changes in the way we use personal information, we will notify you by posting an announcement on our website (www.ingo.me) or by sending you an email. You should review the Privacy Statement for changes each time you use the Application or visit our website.
